Terms of Business
- Clients are billed by GLS 2009 Inc. for services rendered on a weekly basis. Payment is due
in full upon receipt of invoice.
- The interest on past due account
balances is at the rate of 5% per month.
- The Client is responsible for the
accurate and timely tabulation of the total weekly hours worked by the
personnel supplied by GLS 2009 Inc. All errors resulting
from miscalculation by the Client shall be the responsibility of the Client.
- The Client agrees to make hours
worked by personnel supplied by GLS 2009 Inc. (Time Sheets,
Master Time Sheets, Punch Cards, etc.) available to GLS 2009 Inc. in a timely manner on a once weekly basis.
- The Client shall have the full and
sole responsibility to ascertaining the suitability, qualifications and
character of all personnel supplied by GLS 2009 Inc. prior to
their beginning any work assignments. GLS 2009 Inc. makes no
representation or warranty as to the suitability, qualifications and
character of personnel supplied to the customer.
- The Client is responsible for the
direct and indirect supervision, direction and control, job training and
safety of all personnel supplied by GLS 2009 Inc. during the
performance of any and all work or services.
- The Client’s responsibility shall
be complete and all embracing. It is understood and agreed that while
personnel supplied by GLS 2009 Inc. are engaged in the
performance of any work or services on behalf of a customer, the customer
assumes all responsibility and liability for loss or damage occasioned
during the performance of any work or services by such personnel. Without
in any way restricting the generality of the foregoing, the customer shall
have no claim against GLS 2009 Inc. or any right to
indemnification from GLS 2009 Inc. for any loss or damage
caused to the customer or to any third party, however caused, arising from
the user of any machinery, equipment, tools and/or vehicles operated by
personnel supplied by GLS 2009 Inc. during the performance of
any work or services by such personnel, whether any such machinery, tools or
vehicles are owned by the customer or not.
- It is understood and agreed that
the personnel supplied by GLS 2009 Inc. will not be entrusted
with the handling of cash, securities, valuable or negotiable documents,
etc. except at the sole risk of the Client.
- The Customer undertakes and agrees
to indemnify and save GLS 2009 Inc. harmless from any and all
claims against GLS 2009 Inc. for loss or damage occasioned to
any party, including the customer, arising from any act of omission
occasioned as a result of anything done by personnel supplied by GLS 2009 Inc.
- It is understood and agreed that
the Client is free to hire any personnel supplied by GLS 2009 Inc. it deems suitable at no additional charge following eight weeks of
continuous use of that employee by the Client by GLS 2009 Inc. In addition, the Client agrees that the personnel presented to the
Client by GLS 2009 Inc. will not be contacted directly or
indirectly or fired full or part-time by the Client without utilizing the
services of GLS 2009 Inc. for that personnel. GLS 2009 Inc. will invoice at the rate of eight weeks service should the
Client hire, contract or in any way employ personnel presented by GLS 2009 Inc. to the Client outside of these terms.
- All personnel supplied by GLS 2009 Inc. are compensated by GLS 2009 Inc. on a
weekly basis. Payment is made by cheque. Clients are billed for regular
hours at the agreed upon rate per hour. Overtime hours are effective after
forty four hours worked by personnel supplied by GLS 2009 Inc.
and will be billed at one and one half times the straight time rate.
